I would recommend you take legal action now. If they are struggling  
financially, they are almost prioritising payment of debts. The best  
way to get yourself to the top of that list is, in the first place, a  
serious-looking warning letter (try thomashiggins.com) and then court  
action.

Once they go into liquidation, you will be very lucky to get even a  
fraction of what you are owed (unless they have a lot of liquidable  
assets and only a few debts).
