I was in a similar situation recently. An IP lawyer gave me a tip...
Firstly make sure the code you need to protect includes comments clearly
stating ownership. Then put all the code you wish to protect onto a CD and
put it into a sealed envelope. Sign across the seal. Then post the envelope
to yourself by registered post. When you receive the letter, sign for it but
do not open the letter (ensure it remains sealed).
If required in the future, a court (probably only in the UK) will accept
this as proof that the code existed at a specific point in time.
This would prove exactly what you owned before you changed to being an
employee.
