The Google of today isn't necessarily the same as the Google of tomorrow.
You should be fine, for a while - but I wouldn't be surprised if you did
get penalised (more for the id="seo" than the display:none though). If it
looks dodgy (and this does look dodgy) and Google would dislike it (almost
certainly) you can bet reasonable money that sooner or later it's going to
cause problems.

If someone did report it, you can be pretty sure that at that point, a
penalty would be applied.
A penalty doesn't necessarily equate to a permanent ban. You may end up
with very low rankings, or a 30 day ban etc.
